Shipping policy
5. LIABILITY.
5.1 NP Design Studio shall not be liable in case of damages, of any nature whatsoever, resulting from the installation and/or use of the product improperly and/or not in accordance with the instructions provided by the manufacturer, as well as in case of damages resulting from fortuitous events or force majeure.
5.2 NP Design Studio shall not be liable in the event of loss of revenue, profit, data or for any other indirect damage of any nature whatsoever arising from or otherwise connected with the contracts subject to the General Conditions.
5.3 NP Design Studio's liability, in any event, shall not exceed the total value of the purchase order.
6. SUSPENSION OF SERVICE.
6.1 NP Design Studio reserves the right to temporarily suspend, without any prior notice, the provision of the Services for the time strictly necessary for the technical interventions necessary and/or appropriate to improve the quality of the same Services.
6.2 NP Design Studio may, at any time, interrupt the provision of the Service if there are justified security reasons or breaches of confidentiality, giving notice to the user in that case.
7. APPLICABLE LAW AND DISPUTE RESOLUTION.
7.1 The General Terms and Conditions of Sale are governed by Italian law and in particular by Legislative Decree No. 206 of September 6, 2005 and subsequent amendments and additions (Consumer Code) with specific reference to the legislation on distance contracts and by Legislative Decree No. 70 of April 9, 2003 (Implementation of Directive 2000/31/EC on certain legal aspects of information society services in the internal market, with particular reference to electronic commerce)
7.2 For any dispute concerning the validity, interpretation or execution of these General Conditions of Sale the territorial jurisdiction is the Court of Rimini.
8. SHIPPING TIMES AND COSTS.
8.1 Shipping costs are worked out in consideration of minimum shipping volumes, weight ranges and destination areas of shipments, as well as the type of product chosen by the Customer.
8.2 Deliveries are made to the postal address indicated by the Customer during the purchase process stored in the Purchase Order. The Customer is responsible for the address provided. No liability shall be attributable to the Seller for errors in shipment or wrong delivery of products due to inaccuracies or incompleteness in Customer's completion of the Purchase Order.
8.3 Details of shipping times are included in the summary sheet of each product.
8.4 The Carrier is the party responsible for the material delivery of the purchased goods to the Customer. The Carrier is identified at the discretion of the Seller. Any damages, delays or defaults however attributable to the Carrier shall be claimed by the Customer directly against the Carrier, expressly exonerating the Seller from any liability for this purpose.
8.5 Customer acknowledges and agrees that a Purchase Order comprising multiple Goods sold and shipped by different Sellers shall give rise to a single shipment and shall be deemed to be the date of shipment of the Goods with the longest lead time.
8.6 The Customer acknowledges and accepts that a Purchase Order comprising several Goods purchased from the same Seller, if the individual Goods have different production times, the arrival of the product with longer lead times in the warehouse shall be deemed the date of shipment.
8.7 Customers are therefore invited to always check the shipping and delivery times of each individual item, even if from the same Seller.
8.8 Shipments to Italy are free of charge for orders over €250, for San Marino they are free of charge.
8.9 In case of payment by Bank Transfer, the website www.exclusivedesignhouse.com will take charge of the order only after verification that the payment has been credited. Therefore, the delivery time indicated in the Order Summary email will be added to the waiting time of the crediting.
8.10 The risk of loss of or damage to the goods, due to causes not attributable to the Seller, is transferred to the Customer only at the moment when the latter, or a third party designated by him and other than the Carrier, materially takes possession of the goods.
8.11 For purchases where the country of the Seller shipping the goods and the country of the Customer receiving the goods are different, additional customs duties may apply upon delivery of the goods. The Customer is encouraged to contact the customs office in his or her country to verify any additional taxes.
9. MODE OF DELIVERY.
9.1 Deliveries are made by the Carrier identified at Seller's discretion, on weekdays, Monday through Friday, from 9 a.m. to 6 p.m.. It is not possible to choose the time, nor the day of delivery, so it is advisable to indicate a delivery address where someone is always present and, in any case, according to the availability communicated by the Carrier itself.
9.2 The Seller will communicate to the Customer every useful tool in order to correctly identify the traceability of the shipment, as soon as it has received such information from the Carrier.
9.3 Deliveries are expected to be on the ground floor.

10. RECEIPT OF GOODS.
10.1 For the security of the purchase, upon delivery by the Carrier, it will be necessary to verify:
(i) that the package is undamaged, not damaged or wet and, in any case, conforms to the standard characteristics of a package;
(ii) that the tape is intact and not tampered with;
(iii) that the number of packages indicated on the waybill corresponds to the number of packages actually delivered.
10.2 Any disputes must be raised immediately to the Carrier with "non-acceptance" for obvious damage of the contents or acceptance subject to inspection of the contents.
10.3 Discrepancies and damages found to the packaging must be clearly expressed by affixing on the waybill the words "acceptance with reserve" or "reserve control package intact" taking care to specify the type of defect found (e.g. open, damaged packaging on the side, box not intact on the bottom, wet package, etc.).
10.4 Receipt without reservation of the shipment will forfeit any rights to compensation for damage, except in the case of loss or damage to the goods not recognizable at the time of delivery.
10.5 Seller in such cases shall be held harmless from any liability for loss or damage to the goods from the time they are delivered without reservation to the carrier for transportation.
11. NON-DELIVERY AND TERMINATION OF CONTRACT.
11.1 In case of non-delivery due to the absence of the consignee, the Carrier will leave a notice to certify the attempted delivery and the goods will return to the nearest branch. The notice will contain the details for contacting the Carrier again in the manner determined by the Carrier in order to proceed with the delivery of the goods.
11.2 In the event that the Customer does not proceed to pick up the goods in the manner specified by the Carrier, the Customer shall follow the directions provided directly by the Carrier, and also bear the costs arising from any storage of the goods.
11.3 Once 30 days have elapsed since the failure to collect the goods, the contract will be considered terminated and the Seller will refund the amount, net of the costs of reshipment to the sender. Any customs clearance fees will not be refunded.
12. RIGHT OF WITHDRAWAL.
12.1 The Customer has the right to exercise the right of withdrawal from this contract within 14 days of receipt of the goods. The right of withdrawal is exercised by sending an e-mail to the following address info@exclusivedesignhouse.com, communicating: name of the applicant, code and description of the article, details to make the refund. For what is not regulated, the customer acknowledges that the right of withdrawal remains regulated by Articles 54-59 of the Consumer Code (Legislative Decree 206/2005 and smi).
12.2 Once the right of withdrawal has been exercised, the customer must ship the goods subject to the transaction in exactly the same condition in which he received them.
12.3 The Seller will contact a Carrier in order to schedule the collection of the returned goods and the costs of the reshipment will be borne by NP Design Studio.
12.4 NP Design Studio shall not be responsible for any customs clearance charges.
12.5 The Client acknowledges that returns of products that have been customized cannot be accepted.
12.6 It is an essential condition for the exercise of withdrawal by the Client that the integrity of the goods to be returned is preserved. In particular, the Products must not have been worn, used, damaged, or be missing integral elements of the product (accessories, instruction manuals etc..) and must be returned in their original packaging.
13. REFUNDS.
13.1 NP Design Studio, after receiving the return, will make the appropriate verifications and, if positive, will send an email to confirm the return and the provision of the refund within thirty (30) days from the date of receipt of the exercise of the right of withdrawal by the Customer.
13.2 We also remind you that the time to obtain a refund depends on the internal procedures of your Credit Institution.
14. UPDATES.
These General Terms and Conditions of Sale may be amended from time to time also in consideration of any regulatory changes.
